Terms of Service
Welcome to EntPay These Terms of Service ("Terms") govern your access to and use of the EntPay website, applications, and services (collectively, the "Platform") operated by EntPay (Pty) Ltd ("we", "us", or "our"). By accessing or using our Platform, you agree to be bound by these Terms.
1. Eligibility
To use EntPay, you must:
- Be at least 18 years of age.
- Be a resident of or legally present in the Republic of South Africa.
- Have the legal capacity to enter into a binding agreement.
- Provide accurate and complete registration information.
2. Account Registration
You are required to create an account to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that contain false information, are involved in fraudulent activity, or violate these Terms.
3. Services
EntPay provides the following services through its Platform:
- Airtime: Purchase of prepaid airtime for South African mobile networks.
- Data Bundles: Purchase of mobile data packages for supported networks.
- Electricity: Purchase of prepaid electricity tokens from supported municipalities and providers.
- Bank Transfers: Domestic money transfers to South African bank accounts.
Service availability may vary and is subject to third-party provider systems. We do not guarantee uninterrupted availability of any service.
4. Transactions and Payments
All transactions are processed in South African Rand (ZAR). By initiating a transaction, you authorize us to charge the specified amount using your selected payment method. Transactions are considered final once confirmed and processed.
You agree to ensure sufficient funds are available for each transaction. Failed transactions due to insufficient funds or declined payments are your responsibility.
5. Fees and Pricing
Service fees and pricing are displayed before you confirm each transaction. We reserve the right to modify our fees at any time. Changes to fees will be communicated on the Platform and will apply to transactions made after the change takes effect.
6. Refunds
Due to the instant-delivery nature of our services, refunds are generally not available once a transaction has been successfully processed. Refunds may be considered in the following cases:
- Duplicate transactions caused by a system error on our end.
- Transactions where the service was not delivered due to a failure in our systems.
- Incorrect amounts charged due to a platform error.
Refund requests must be submitted within 7 days of the transaction. Each request will be reviewed on a case-by-case basis. We are not responsible for transactions made with incorrect details provided by you (e.g., wrong phone number or meter number).
7. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of South African law.
- Provide false, misleading, or fraudulent information.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use automated tools, bots, or scripts to access the Platform without our written consent.
- Engage in money laundering, fraud, or any form of financial crime.
- Interfere with the proper functioning of the Platform.
- Resell our services without authorization.
8. Intellectual Property
All content, branding, logos, designs, and software on the Platform are the property of ENTPAY.IO (Pty) Ltd and are protected by South African and international intellectual property laws. You may not copy, modify, distribute, or reproduce any part of our Platform without prior written consent.
9. Limitation of Liability
To the maximum extent permitted by South African law, ENTPAY.IO shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:
- Loss of profits, data, or business opportunities.
- Service interruptions caused by third-party providers, network operators, or utility companies.
- Delays or failures in transaction processing beyond our reasonable control.
Our total liability for any claim related to the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, availability, or fitness for a particular purpose of our services. We do not warrant that the Platform will be error-free or uninterrupted.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to the practices described in the Privacy Policy.
12. Modifications to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Platform ceases immediately. Any pending transactions at the time of termination will be handled on a case-by-case basis.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of South Africa.
